1.Acceptance of Terms

These Terms constitute a legally binding agreement between you and Amar Khade under the Indian Contract Act, 1872. Your continued use of the Website after any update to these Terms constitutes acceptance of the revised Terms. These Terms should be read together with our Privacy Policy and Refund / Cancellation Policy, which are incorporated here by reference.

2.Definitions

"Website" means amarkhade.com and its associated pages. "Content" means all text, books, articles, poems, images, audio, graphics, and other material published on the Website. "Products" means physical or digital books and merchandise offered for sale. "Services" means the Website, its Content, the newsletter, the contact form, and any Products made available through the Store. "Applicable Law" means the laws of India, including but not limited to the Information Technology Act, 2000, and rules made thereunder.

3.Eligibility & Permitted Use

The Website is intended for use by individuals who are at least 18 years old, or who are using it under the supervision of a parent or legal guardian, and who are capable of entering into a binding contract under the Indian Contract Act, 1872. You agree to use the Website only for lawful purposes and in a manner consistent with these Terms and Applicable Law.

You agree not to:

• Copy, reproduce, republish, or distribute Content without prior written permission;
• Use any automated means (bots, scrapers, crawlers) to access or extract data from the Website without authorisation;
• Attempt to gain unauthorised access to the Website, its systems, or related networks;
• Upload or transmit any unlawful, defamatory, obscene, or infringing material through the contact form or any other input on the Website;
• Interfere with the security, integrity, or normal operation of the Website, including through introduction of malware or denial-of-service activity.

4.Intellectual Property Rights

All Content on the Website — including but not limited to book text and excerpts, articles, poems, the Amar Khade name, brand marks, photographs, illustrations, and the design and layout of the Website — is the exclusive property of Amar Khade and is protected under the Copyright Act, 1957, applicable trademark law, and other intellectual property laws of India and, where relevant, international treaties. No Content may be reproduced, modified, distributed, publicly displayed, or used to create derivative works without prior written consent, except for personal, non-commercial reading and fair-dealing uses expressly permitted under the Copyright Act, 1957.

5.Books, Products & Services

Books and other Products may be made available for purchase either (a) via links that direct you to third-party marketplaces such as Amazon, in which case your purchase is governed by that marketplace's own terms, policies, and conditions, and Amar Khade is not a party to that transaction; or (b) via a direct, hosted checkout facilitated by a licensed Indian payment aggregator (such as Razorpay or Instamojo), in which case these Terms, the Refund / Cancellation Policy, and the applicable payment gateway's terms govern the transaction. We make reasonable efforts to describe Products accurately, but do not warrant that descriptions, pricing, or availability shown on the Website are always error-free, complete, or current, and reserve the right to correct any errors and to modify or discontinue any Product at any time.

6.Pricing, Payments & Taxes

All prices displayed on the Website are in Indian Rupees (INR) unless stated otherwise, and are inclusive or exclusive of applicable Goods and Services Tax (GST) as indicated at the point of sale. Where payments are processed through a third-party payment aggregator, such processing is subject to the Payment and Settlement Systems Act, 2007, applicable Reserve Bank of India (RBI) guidelines, and the aggregator's own security and compliance standards (including PCI-DSS where applicable). We do not store your card, UPI, or net-banking credentials; these are handled exclusively by the payment gateway.

7.Shipping, Delivery & Digital Access

Where physical Products are sold directly, shipping timelines, carriers, and delivery areas will be stated at the point of sale and are subject to change due to logistics, courier delays, or circumstances beyond our reasonable control. Where Products are fulfilled via a third-party marketplace (e.g. Amazon), delivery is governed entirely by that marketplace's shipping policies. Where digital content or access is provided, access details will be shared to the email address provided at checkout or via the contact form.

8.Cancellations, Returns & Refunds

Cancellations, returns, and refunds for direct purchases are governed by our Refund / Cancellation Policy, which forms part of these Terms. Purchases made through a third-party marketplace such as Amazon are governed exclusively by that marketplace's own return and refund policy, and requests relating to such purchases should be directed to the marketplace, not to us.

9.User Submissions & Newsletter

Information you submit through the contact form (name, email, and message) is used solely to respond to your enquiry and is handled as described in our Privacy Policy. By subscribing to the newsletter, you consent to receive periodic email communications from us; you may unsubscribe at any time using the link provided in each email or by writing to us. We do not sell or rent your personal information to third parties. Any feedback, testimonial, or message you voluntarily share with us may be used, in an anonymised or attributed form with your consent, to feature on the Website.

10.Third-Party Links & Payment Gateways

The Website contains links to third-party platforms, including Amazon, Instagram, Facebook, WhatsApp, and payment gateways such as Razorpay or Instamojo. These third parties operate independently, maintain their own terms of service and privacy policies, and are not controlled by us. We are not responsible for the content, security, policies, or practices of any third-party website or service, and your use of them is at your own discretion and risk.

11.Disclaimer of Warranties

The Website and its Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted under Applicable Law, including the Consumer Protection Act, 2019. We do not warrant that the Website will be uninterrupted, secure, or error-free, or that any views, opinions, or personal-development content expressed will produce any particular outcome for any individual reader.

12.Limitation of Liability & Indemnification

To the maximum extent permitted by Applicable Law, Amar Khade shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Website or Services. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount actually paid by you, if any, for the specific Product or Service giving rise to the claim. You agree to indemnify and hold harmless Amar Khade from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Website, or violation of any Applicable Law or third-party right.

13.Governing Law, Jurisdiction & Grievance Redressal

These Terms are governed by and construed in accordance with the laws of India. Subject to the grievance process below, the courts at Chandrapur / Nagpur, Maharashtra, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, without regard to conflict-of-law principles. Visitors accessing the Website from outside India do so on their own initiative and are responsible for compliance with local laws, to the extent such local laws apply.

14.Miscellaneous & Changes to These Terms

Force majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disaster, internet or telecommunications failure, government action, or payment-gateway outage.

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire agreement: These Terms, together with the Privacy Policy and Refund / Cancellation Policy, constitute the entire agreement between you and Amar Khade regarding use of the Website.

Changes: We may revise these Terms from time to time to reflect changes in Applicable Law or our Services. The "Last updated" date at the top of this page will be revised accordingly, and material changes may additionally be notified via the newsletter or a notice on the Website.

15.Affiliate / Referral Program

Affiliate Program Terms — version 1.0, added 10 July 2026.

This section governs participation in the amarkhade.com affiliate program ("Program"), reachable via the Earn page. It applies in addition to the rest of these Terms. By registering for the Program, you ("Affiliate", "you") agree to the following, in addition to the general Terms above.

Eligibility. You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872, to join the Program. Each person may hold only one Affiliate account. We may decline or suspend registration at our discretion.

What counts as a referred sale. Only purchases completed directly on amarkhade.com, attributed to your unique referral code or link at the time of checkout, count toward your commission. Purchases made through third-party marketplaces (including Amazon) are not part of the Program and generate no commission, regardless of whether you referred the buyer. A referral is recorded only once a payment is verified as successful; abandoned or failed payments do not count.

Commission & discounts. The commission rate and any discount extended to a buyer using your code are set per product and may be changed by us at any time for future sales; changes do not affect commission already earned on completed sales. Commission is calculated on the net sale amount actually received, and is reduced or reversed in full for any sale that is later refunded, charged back, or cancelled.

Self-referrals & fraud. Using your own referral code or link to purchase for yourself, or engaging in any fraudulent, misleading, spammy, or abusive promotional activity (including impersonation, false claims about our products, or unsolicited bulk messaging), is prohibited. We may withhold, reverse, or claw back any commission arising from such activity, and may suspend or terminate your Affiliate account at our discretion, with or without notice.

Payouts. Approved commission is paid out manually, by UPI or bank transfer, after a short settling window to account for possible refunds, once your approved balance crosses the minimum payout threshold shown in your dashboard. You are responsible for providing accurate payout details and for any tax obligations (including TDS or GST, as applicable under Indian law) arising from commission you earn; we may request documentation required for tax compliance before releasing a payout.

Communication consent. By registering for the Program, you consent to being contacted on the WhatsApp number and email address you provide, for communication related to the Program (including referral tools, payout status, and policy updates).

Termination. You may stop participating at any time by writing to us. We may end or modify the Program, or your participation in it, at any time. Commission already earned on verified, non-fraudulent, completed sales made before termination will still be paid out under the normal payout schedule above.
